The petitioner, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 5(i), 5(j) (ii) & 6(1) POCSO Act in Crime No.28 of 2024 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner had committed the sexual assault on the minor victim girl aged about 14 years, due to which, she became pregnant and delivered a child. Hence the case.

3. The learned counsel for the petitioner submitted that there was a love affair between the petitioner and the minor victim girl and the petitioner without understanding the consequences has indulged in the relationship. Hence, the present petition has been filed seeking anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the petitioner is a adult aged about 27 years and the victim is a minor aged about 14 years. He has induced the minor victim girl had committed sexual assault resulting in the victim becoming pregnant and delivering a child. Hence, he opposed for grant of anticipatory 1/3

bail to the petitioner.

A.D.JAGADISH CHANDIRA,J., nvi 5.Heard the learned counsel for the petitioner and the learned Government Advocate (crl.side) for the respondent police and perused the materials available on record.

6.Taking into consideration the facts and circumstances of the case, the submissions made by the learned counsel on either side and also the age of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.

7.Accordingly, this Criminal Original Petition is dismissed. 12.11.2024 nvi 2/3
