This petition has been filed seeking to condone the delay of 80 days in filing the appeal.

2.The learned counsel appearing for the petitioner submits that the first respondent was exparte before the Tribunal and hence notice to the first respondent may be dispensed with and has also made an endorsement to that effect in the bundle.

3.In view of the endorsement made by the learned counsel appearing for the petitioner, notice to the first respondent is dispensed with. Mr.J.Chandran, learned counsel takes notice for the second respondent.

4.Being satisfied with the reasons stated in the affidavit filed in support of this petition, this petition is ordered and the delay of 80 days in filing the appeal is condoned.
