The petitioner who apprehends arrest at the hands of the respondent police for the offence punishable under Section 24(1) of Cigarette and Other Tobacco Products Act, 2003, r/w 123 of the BNS Act 2023, in Crime No.1034 of 2024 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that on 04.11.2024, when the respondent police has received a information from the Sub-Inspector of Police who was patrolling and checking the vehicle. At around 05.00 p.m.,to 6.00p.m., near North-West, Tirutthani one Magesh had banned tobacco products for selling. Hence the complaint.

3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prayed for grant of anticipatory bail to the petitioner. 4.Learned Government Advocate (Crl.Side) appearing for the respondent police while opposing for grant of anticipatory bail submitted that there are four previous cases are pending against him. https://www.mhc.tn.gov.in/judis 1/2

Crl.O.P.No.28358 of 2024 A.D.JAGADISH CHANDIRA,J., nvi 5.Heard the learned Counsel for the petitioner and the learned Government Advocate (crl.side) and perused the materials available on record.

6.Taking into consideration the nature and gravity of the offence committed by the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
