Though the learned counsel appearing for the respondents 1 to 5 would vehemently contend that the reasons assigned for the delay are unacceptable. We find that the delay occurred due to the pendency of a review and the order in the review petition was challenged by way of a separate Appeal.

2. A Division Bench of this Court had held that the correctness of the order in the Writ Petition as well as the Review Petition can be canvassed in the Appeal filed against the order in the Writ Petition.

3. In view of the same, refusal to condone delay would result in denial of opportunity to the appellant to canvas the correctness of the order in the Writ Petition. Hence the delay is condoned.
