Respondent PRAYER: Criminal Original Petition is filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 to withdraw the rejection order issued by the petitioner on 08.09.2020 and to issue non traceable certificate belonging to Sale deed Document No.4180 of 1997 which is missing vide CSR.258 of 2020 on the file of respondent police complaint given by the petitioner.

O R D E R

This Criminal Original Petition has been filed challenging the order rejecting the application submitted by the petitioner for the issuance of non-traceable certificate in view of Sale Deed Document No.4180 of 1997.

2. The learned Government Advocate (Crl.side) would submit that on receipt of the complaint lodged by the petitioner, CSR No.258 of 2020 was issued and an investigation was conducted. During the investigation, it was found that the petitioner is not the title holder of the property. In an attempt to claim ownership, the petitioner lodged the complaint seeking the issuance of a non-traceable certificate.

3. In view of the submission made by the learned Government Advocate (crl.side), this Court is not inclined to grant withdrawal of the rejection order passed by the respondent. Accordingly, the Criminal Original Petition is dismissed.
