ORDER

This Criminal Revision Case has been filed as against the Judgment dated 31.07.2019 passed in C.A.No.40 of 2018 on the file of the District and Sessions Judge, Tiruvarur, thereby confirming the order dated 03.07.2018 passed in C.C.No.103 of 2009 on the file of the Judicial Magistrate No.II, Mannargudi,

thereby acquitted the respondent for the offence punishable under Sections 498(A) and 506(ii) of IPC.

The case of the prosecution is that, based on the complaint lodged by the petitioner, the Trial Court had taken cognizance for the offences punishable under Sections 498(A) and 506(ii) of IPC and issued summons to the respondent. The allegation of the petitioner is that she married the first respondent herein and even from the date of marriage, the respondent subjected her to harassment by demanding further dowry. It is further alleged that the jewels, which were presented at the time of marriage, were mortgaged by the respondent and that he failed to redeem the same thereafter. The respondent also administered some poison in a drink and committed theft. However, the petitioner failed to substantiate the said allegations by adducing any acceptable evidence. All the allegations are bald and vague and there was no specific allegations. Therefore, the Trial Court rightly acquitted the respondent, confirmed by the Appellate Court.

In view of the above, there is absolutely no ground to interfere with the concurrent findings of the Trial Court as well as the Appellate Court. Hence, this Criminal Revision Case stands dismissed. 25-03-2026 Index: Yes/No Speaking/Non-speaking order LPP
