PRAYER: Original Petition filed for Succession Certificate under Section 372 of Indian Succession Act 1925 read with Order XXV Rule 6 of the Madras Original Side Rules, prays that a Succession Certificate may be granted to the First petitioner, Sridhar Rentala with power to collect the securities and to receive the interest and dividends on and negotiate and transfer the securities specified in the schedule hereto. ORDER
The petitioners seek Succession Certificate in respect of the securities held by Late.R.V.Subba Rao, who died intestate on 17.10.2009. The 1st and the 2nd petitioners are the sons and the 3rd petitioner is the wife of the deceased.
2. The first petitioner has been examined as PW1. He has produced the 1/4
computer generated death certificate of the deceased Late.R.V.Subba Rao as Ex.P1. The legal heirship certificate of the deceased has been marked as Ex.P2. The aadhar card of the 1st petitioner has been marked as Ex.P3. A perusal of Ex.P2 shows that the petitioners are the only legal heirs of the deceased Late.R.V.Subba Rao. The 2nd and the 3rd petitioners have expressed their consent to allow the original petition and their consent affidavits have been filed along with the petition. A paper publication has been made which has been marked as Ex.P5 and no objections have been received.
3. The assertions in the petition have been duly proved by adducing oral evidence supported by documents. In these circumstances, the petitioners are entitled to the relief.
4. In view of the above evidence, the Original Petition is allowed granting Succession Certificate in favour of the first petitioner, with the power to collect the securities and receive the interest and dividends on and negotiate and transfer the securities mentioned in the schedule to the petition.
