JUDGMENT
(The judgment of the Court was delivered by J.Nisha Banu,J.) The above Civil Miscellaneous Appeal has been filed by the appellant/wife against the order passed by the learned V Additional Page 1/3
Judge, Family Court in O.P.No.4142/2016, in which, the petition filed by the respondent/husband seeking restitution of conjugal rights, was allowed.
2. Today, a memo has been filed by the learned counsel for the appellant stating that the appellant has filed a petition for divorce before the Family Court, Medchal- Malkajgiri District, Hyderabad, in F.C.O.P.No.486 of 2024. Since the divorce petition has been filed by the appellant before the Hyderabad Court, the appellant seeks permission of this Court to withdraw this Appeal.
2. The said memo is recorded. In view of the submission made by the learned counsel for the Appellant and considering the memo filed by the appellant, this Civil Miscellaneous Appeal is dismissed as withdrawn. No costs.
