Prayer: This Civil Revision Petition is filed under Article 227 of the Constitution of India, praying for a direction to the trial Court to dispose of the (Not Press Memo in CFR.No.3280 of 2023) in O.S.No.803 of 2022, pending on the file of the Principal District Court at Tiruppur, within a stipulated period as prescribed by this Court by allowing the civil revision petition.

O R D E R

This civil revision petition has been filed for a direction to the learned Principal District Judge, Tiruppur, to dispose of the (Not Press Memo in CFR.No.3280 of 2023) in O.S.No.803 of 2022.

2.I called for a report from the learned Principal District Judge, Tiruppur, on 26.11.2024.

3.The learned Principal District Judge, Tiruppur, has sent a report dated 07.12.2024, stating that III Additional District Judge, Dharapuram, has taken charge only on 06.11.2024 and the case is now posted on 05.12.2024 for filing written statement by D1 to D7 & D10, for filing objection in the memo filed by the plaintiff to not press the suit that I.A.No.2 of 2024 seeking 2/4

transpose of defendants 1, 4 & 6 as the plaintiff, is also pending for filing counter.

4.The learned Principal District Court at Tiruppur, shall consider the withdrawal of memo and transpose application together and pass orders. In case, the learned Judge finds that the transpose application deserves to be allowed, he shall complete the suit within a period of six (6) months from the date of receipt of a copy of this order and to submit a compliance report to this Court.

5.With the above directions, this Civil Revision Petition is ordered. No costs.
