ORDER

This petition has been filed under Section 11 of the Arbitration and Conciliation Act, 1996, seeking for appointment of an Arbitrator by this Court.

2. Both the counsels, on instructions, have made a joint endorsement in the Court bundle agreeing for the appointment of an arbitrator by this Court. Only on instructions received from their respective clients, they have made the aforesaid endorsement. They have also agreed for the appointment of Mr.P.J.Rishikesh, Advocate, to act as the Sole Arbitrator to adjudicate the dispute between the petitioner and the respondent arising out of the Construction Agreement dated 17.09.2023.

3. In view of the joint endorsement made by both the counsels, on instructions, this Arbitration Original Petition is allowed as prayed for by issuing the following directions:

(a) Mr.P.J.Rishikesh, Advocate, having office at No.10A, 14th Page No.2 of 4

Avenue, Harrington Road, Chetpet, Chennai - 600 031 (Mobile No.98411 88677) is appointed as the sole Arbitrator to decide the dispute between the petitioner and the respondent arising out of the Construction Agreement dated 17.09.2023;

(b) The Arbitrator shall be paid his remuneration / fees in accordance with the 4th schedule of the Arbitration and Conciliation Act, 1996 or as per the mutual consent of both the parties; (c) Both the parties shall equally share the arbitrator's fees; (d) The Arbitrator shall conduct the arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996 and shall complete the arbitration within the specified time as prescribed under the said Act.
