This case came up for settlement before the National Lok Adalat. Both the parties are present. Mr.U.Chithambaram, learned counsel for the appellant and Mr.D.Bhaskaran, learned nd respondent/Insurance Company are present.
counsel for 2 After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:
TERMS OF SETTLEMENT The appellant has preferred this Civil Miscellaneous Appeal seeking to enhance the Award dated 19.10.2024 in M.C.O.P.No.5434 of 2019 passed by the learned Chief Judge, Court of Small Causes, Motor Accident Claims Tribunal, Chennai.
2. The Tribunal has passed an award of Rs.6,80,000/- with interest at the rate of 7.5% per annum from the date of petition till the date of deposit along with cost.
3. The parties are present along with their respective counsels.
4. After great deliberation and discussion, both the parties have agreed for enhancement of award amount with further additional sum of Rs.4,00,000/- in full quit (inclusive of interest).
5. In view of the compromise arrived at between the parties, the National Lok Adalat hereby declare and decree nd respondent/Insurance Company shall deposit the that 2 enhanced award amount of Rs.4,00,000/- (Rupees Four Lakhs only) in full quit (inclusive of interest), within a period of six weeks from the date of receipt of a copy of this award. On such deposit, appellant is permitted to withdraw the enhanced award amount immediately, without filing any formal petition, before the competent Court.
6. The Tribunal is directed to issue the cheques to the parties concerned on proper identification in accordance with the terms of the award, without insisting on any formal permission petition. The Civil Miscellaneous Appeal is disposed of accordingly.
