ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025. 2.The case was registered in Cr.No.76 of 2006 for the alleged offence under Section 379 I.P.C. It is reported that totally there are five accused in this case. The allegation in this case is that the accused have stolen the aluminum rod that is fixed in the transformer belong to the Tamil Nadu Electricity Board and sold the property and spent the money and nothing was recovered. Under the said circumstances, one of the accused died and other accused have Page No.1 of 3

attending the Court regularly.

smv 3.Considering the nature of the offence and the fact that there is no other previous case or subsequent case against the accused and also considering the Probation Officer's Report, which is in their favour demonstrating good conduct and being the first offener, one opportunity can be granted to them and any further continuation of the case will impinge upon the right to a speedy trial. Accordingly, the case in C.C.No.601 of 2023 of the District Munsif Cum Judicial Magistrate, Annur, Annur Taluk, Coimbatore, stands quashed. This Suo Motu Transfer Case is disposed of. 07.10.2025 smv electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
