ORDER
This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025. 2.This case in Cr.No.240 of 2021 dated 21.06.2021 was registered for the alleged offences under Sections 4 (1) (aaa) of TN Prohibition Act. The allegation in this case is that the accused was found to be in possession of 176 bottle of liquor which was to be sold only in Karnataka State without any license.
3.Considering the nature of allegations and the accused had only one Page No.1 of 3
similar case, in which also, he was acquitted and there is no other subsequent case and this case is pending from 21.06.2021 and summon itself is not served. Since there is no other subsequent case, any further service of summons will infringe upon the accused's right to a speedy trial. No useful purpose will be served by keeping the matter pending.
4.Accordingly, the case in CC.No.85 of 2021 on the file of the Principal District Munsif cum Judicial Magistrate, Gudalur Taluk, Nilgiris, stands quashed. This Suo Motu Transfer Case is disposed of. 07.10.2025 sms electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
