Respondents Prayer:- Writ Petition filed under Article 226 of Constitution of India for the issuance of Writ of Mandamus, directing the seventh respondent to consider petitioner's representation dated 05.12.2022 consequently not to disburse any amount from Saving Account No.11073679438 with the seventh respondent maintained by the deceased Nagappan, until the petitioner claims are adjudicated upon and decided in the manner known to law.

ORDER

This Writ Petition has been filed for a direction directing the seventh respondent to consider the representation submitted by the

petitioner dated 05.12.2022 seeking not to disburse any amount from Saving Account No.11073679438 with the seventh respondent maintained by the deceased Nagappan, until the petitioner claims are adjudicated upon and decided in the manner known to law.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondents 1 to 4 and the learned counsel appearing for the eighth respondent and perused the materials available on record.

3. It is seen that the petitioner's daughter got married to one K.Nagappan. The petitioner's daughter was working as a teacher and died due to COVID-19. The terminal benefits of the deceased daughter of the petitioner was disbursed in favour of her husband, viz., K.Nagappan. The said K.Nagappan's account is with the seventh respondent. After depositing the said amount, the petitioner's son-in-law, viz., the said K.Nagappan, died. Now, the eighth respondent, who is the mother of the said Nagappan, received the entire amount, which was lying in the account of the seventh respondent Bank in the name of

K.Nagappan. Subsequently, the petitioner also filed a petition seeking succession certificate and it is pending on the file of the Second Additional District Court, Ranipet in S.O.P.No.1 of 2023.

4. In view of the above, if the petitioner succeeds in S.O.P.No.1 of 2023, she can make a claim as against the eighth respondent in the manner known to law.

5. With the above direction, this writ petition stands disposed of. No costs.
