Petition filed under Article 226 of the Constitution of India for issuing a writ of mandamus directing the respondent to adhere the G.O.Ms.No.92, Municipal Administration and Water Supply (MCII) Department dated 03.07.2007 in renewing the lease of Shop No.9 (Allotment No.044/227), East Pondy Road, Villupuram and consequently restraining the respondent from demanding and collecting arbitrarily fixed rent as per the letter Na.Ka.No.14546/2016/A5 dated 04.05.2017 and/or demanding more than 15% of the lease amount fixed for the previous block period.

Consistently, there is no representation for the petitioner. When the matter was listed for hearing on 20.11.2020, there was no representation for the petitioner, hence, the matter was adjourned to 04.12.2020. On 04.12.2020 also, there was no representation for the petitioner and hence, the Registry was directed to list the matter under the caption "for dismissal" on 08.12.2020. Though the matter has been listed under the caption "for dismissal", today also, none appeared for the petitioner. Hence, this Court has no other option, except to dismiss the Writ Petition for nonprosecution. Accordingly, the Writ Petition is dismissed for non-prosecution. No costs. Consequently, the connected miscellaneous petition is closed.
