ORDER

The petitioner, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 334(2) & 305(a) of BNS Act 2023, in Crime No.454 of 2025 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that the container lorry bearing Registration No.TN 28 AD 1909, carrying Nike garments and footwear, went missing along with drivers Rajesh, Saravanan, and Sasikumar, prompting a police complaint as custom records show no entry. Hence, the case. 3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he is no way connected with the offence as alleged by the prosecution. Hence, he prays for grant of bail to the petitioner. 4.The learned Government Advocate (Crl.Side) for the respondent police reiterated the prosecution and on instructions submitted that the contained lorry loaded with Nike Garments materials and foot wears were missing and the

investigation in this case is not concluded. Hence, he opposed for the grant of anticipatory bail to the petitioner. He further submitted that he is the main person who assisted with other accused to commit the forgery, which needs detailed investigation.

5.Considering the submissions made by the learned Government Advocate (Crl.Side), and the petitioner and other accused persons were planned and committed robbery, which needs detailed investigation, and on seeing the gravity of the offence committed by the petitioner and the fact that at this stage, if he is released on bail, there is possibility of tampering evidence and hampering investigation, this Court is not inclined to grant bail to the petitioner.
