Prayer : Civil Revision Petition filed under Article 227 of the Constitution of India, to direct the Trial Court to dispose the suit in OS No. 1193 of 2010 pending on the file of III Additional Sub Court, Coimbatore within a stipulated Period.

O R D E R

This civil revision petition seeks for expeditious disposal of O.S.No.1193 of 2010 on the file of the learned III Additional Subordinate Judge at Coimbatore. The said suit is one for partition and separate possession.

2. When the matter came up for admission, I called for a report from the learned III Additional Subordinate Judge at Coimbatore.

3. The learned Judge has submitted a report stating that, as the respondent in I.A.No.17 of 2011 is not cooperating for the disposal, he is unable to proceed further in the matter. The civil revision petitioner is the said respondent. On the one hand, he cannot plead that the suit is pending and on the other hand, not cooperating with the court for the purpose of disposal.

4. The learned Trial Judge is requested to dispose of I.A.No.17 of 2011 within a period of 4 weeks from the date of receipt of a copy of this Order and thereafter, take up the suit for disposal. The suit shall be disposed of within a period of six months from the date of disposal of I.A.No.17 of 2011.

5. With the aforesaid directions, this civil revision petition is ordered. No costs.
