O R D E R

(Order of the Court was made by S.M.SUBRAMANIAM, J.) The Contempt Petition has been instituted to punish the respondents for willful disobedience of the orders of this Court dated 22.06.2023 in W.P.No.19298 of 2020.

2. This Court directed the Authorities to evict the encroachers by following the procedures as contemplated under law. Therefore, the order of this Court may not cause prejudice to the encroachers who are all not parties to the writ proceedings. In respect of all those encroachers the Government Pleader would submit that notice under Section 7 of the Tamil Nadu Land Encroachment Act, 1905 [hereinafter referred to as "the Act"] was issued and only after affording opportunity to those encroachers further actions are initiated under Section 6 of the Act. Aggrieved persons may prefer an appeal under Section 10 of the Act. The subject land has been classified as "meikal poramboke" (grazing land). Therefore the encroachers cannot claim any right over the Government land and they are liable to be evicted by following the procedures as contemplated under the provisions of the Act.

3. In the present case, the learned Government Pleader would submit that actions are already been initiated by issuing notice to the encroachers and all such encroachers will be removed after completion of procedures already initiated.

4. This being the submission, the respondents have not committed any willful disobedience of the orders of this Court. However, it is made clear that action initiated must be continued and all the encroachers are to be removed without causing any unnecessary delay. In the event of any delay in completing the procedure, the official respondents are to be held accountable and disciplinary actions are to be initiated against those officials.
