The petitioner seeks bail in Crime No.163 of 2023, registered by the respondent police for the offences punishable under Section 6 of POCSO Act. The petitioner had been taken into custody on 05.11.2023. 2.The learned counsel for the petitioner stated that the victim child is the cousin sister of the petitioner herein. She is a minor studying 10th standard.
3.It is stated that aggravated penetrative sexual offence had been committed by the petitioner on the victim child. 4.The learned Public Prosecutor (Puducherry) for the respondent pointed out that the medical report had also confirmed that there was recent aggravated penetrative sexual assault committed against the victim child and investigation is still pending. 5.In view of all these facts, I am not inclined to grant bail to the petitioner at this stage. Accordingly, this Criminal Original Petition stands dismissed.
