O R D E R

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 296(b), 118(1), 351(3) of 1/6

of BNS Act, 2023 r/w Section 4 of TNHW Act in Crime No. 540 of 2025, on the file of the respondent Police, seeks anticipatory bail.

2. The case of the prosecution is that due to family dispute, a quarrel arose between the defacto complainant and the petitioners in which the petitioners are alleged to have attacked the defacto complainant due to which, he sustained grievous injuries. Hence, the case.

3. The learned counsel for the petitioner submits that the petitioners are innocent persons and they have been falsely implicated in this case. He also submits that the petitioners are ready to abide by any conditions that may be imposed by this Court and ready to furnish sufficient solvent sureties for their release. Hence, he prays for grant of anticipatory bail to the petitioners.

4. The learned Government Advocate (Criminal side) for the respondent police, reiterated the prosecution case and submits that this is a second anticipatory bail application and there is no change of circumstances in this case. He submits that defacto complainant went for filling of water at that time, the 1st accused entered into wordy quarrel with the defacto complainant and attacked him with wooden log. He also submits that the injured has been discharged from the hospital. However, he 2/6

opposed to grant anticipatory bail to the petitioner.

Considering the above facts and circumstances of the case , taking note of the submission made by the learned Government Advocate (Criminal Side), considering the fact that this is a 2nd anticipatory bail application and there is no change of circumstances in this case, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition stands dismissed. 16.09.2025 nr To 1.The Judicial Magistrate No.I, Tiruvallur.
