O R D E R

The petitioner, who was arrested and remanded to judicial custody on 08.04.2025, pursuant to a non-bailable warrant issued in S.C.No.51 of 2024 on the file of IV Additional District Judge, Thiruvallur , Ponneri, for the offences punishable under Sections 147, 148, 341, 450, 302 1/4

r/w 120(b) , 302(3 counts) r/w 149 of IPC in Crime No. 896 of 2023, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that due to non-appearance before the Trial Court on 25.03.2025, NBW was issued against the petitioner on 25.03.2025 and the same was executed on 08.04.2025. Hence, the case.

3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He also submitted that the petitioner is no way connected with the alleged offence however, he is suffering incarceration from 08.04.2025. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

4. The learned Government Advocate (Crl.side) for the respondent police submits that this is a case of triple murder. He submits that this is a sixth bail application and this Court had dismissed the earlier bail petitions filed by the petitioner. He further submits that NBW was issued against the petitioner on 25.03.2025 and the same was executed on 08.04.2025. He also submits that there are totally 47 witnesses and the case is posted for examination of L.W.12 and L.W.13 on 18.09.2025. He also submits that the 2/4

petitioner is having one previous case which is registered under NDPS Act. Hence, he strongly opposed to grant bail to the petitioner.

This Court has continuously dismissed the bail petitions filed by the petitioner considering the gravity of the offence committed by the petitioner and the stage in which the petitions are considered and noting that there is no change in the circumstance of the case. Since the trial is in progress and it is pending for examination of further witnesses and the trial is likely to be concluded, if the bail is granted at this stage, the petitioner is likely to tamper the evidence and hamper the investigation. Hence, this Court is not inclined to grant bail to the petitioner.
