O R D E R

This Writ Miscellaneous Petition has been filed to recall the order passed by this Court in W.P.No.35250 of 2022 dated 01.04.2025.

2. When the matter was taken up for hearing today, it was brought to the notice of this Court that survey has already been conducted on 04.09.2025. In fact, the first respondent/writ petitioner had filed a contempt petition in Cont.P.No.2943 of 2025 and it was closed today, after recording the fact that the survey has already been conducted and a direction was given to the Official respondents therein to serve the survey report to the petitioner.

3. The main grievance that was expressed by the learned counsel appearing for the petitioner/respondent No.6 is that in the strength of the survey conducted, the writ petitioner is making attempt to take over the 2/5

possession of the property. The order passed by this Court in the writ petition does not go beyond conducting survey in the subject property. By no stretch, this Court had given permission to any party to take possession of any property. This clarity will sufficiently take care of the grievance expressed by the petitioner/respondent No.6.

4. Accordingly, this Writ Miscellaneous Petition is disposed of in the above terms. There shall be no order as to costs. 12-09-2025 ssb 3/5
