ORDER

The petitioners, who were arrested and remanded to judicial custody on 07.08.2025, for the offences punishable under Sections 85 and 108 of BNS in Crime No.456 of 2025, registered on the file of the respondent police, seek bail.

The case of the prosecution is that the petitioners herein are the parents-in-law of the deceased, who committed suicide by hanging due to the demand of dowry and cruelty made by the first accused along with these petitioners. Hence, this case.

The learned counsel appearing for the petitioners submitted that the petitioners have not committed any offence as alleged by the prosecution and they were roped in this case as they are the parents-in-law of the deceased; that the petitioners are aged persons and taking medical treatment towards their health ailments and they are in judicial custody since 07.08.2025. He further submitted that the petitioners are ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioners.

The learned counsel appearing for the intervener raised strong objection in granting of bail to the petitioner by stating that, the deceased is the daughter of the defacto complainant and the marriage between the deceased and A1 was solemnized on 15.09.2024 and at the time of marriage, the defacto complainant had offered Rs.20 lakhs money and 80 sovereigns of gold jewels to A1 as dowry as demanded by the accused persons. He further submitted that after the marriage, A1 and the petitioners herein demanded further dowry, started advancing physical and mental harassment against the deceased; that while so, the petitioner left the deceased at the defacto complainant's home for her infertility treatment, due to distress and mental agony, the defacto complainant's daughter committed suicide by hanging.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioners, reiterated the prosecution case and states that the petitioners along with their son, who is the first accused have instigated and abetted the daughter of the defacto complainant in committing suicide on demand of dowry; that the RDO enquiry is yet to be concluded and the investigation of this case is pending. 3/4

Considering the facts, grave nature of offence, the RDO enquiry report is yet to be received and the investigation is still pending, this Court is not inclined to grant bail to the petitioners at the present. 7.
