This petition has been filed seeking to condone the delay of 81 days in filing the above appeal.
2. Mr.S.Namasivayam, learned counsel for appellant submitted that due to covid restrictions and also the time was extended as per suo motu order of this Court in W.P.No.3 of 2020, the appeal against the judgment of trial court was not filed in time. Furthermore, when the appellant got ready with all relevant papers to file appeal, he became unwell, it was not filed in time. However, there is a delay of 81 days in filing the above appeal arose and the delay is neither willful nor negligent. Therefore, he filed this petition to condone the delay in filing the above appeal.
3. Considering the facts and circumstances and also considering the reasons assigned by the petitioner in the affidavit seems to be justifiable one, this court is inclined to allow this petition. Post the matter on 28.06.2023.
