PRAYER : Criminal Original Petition has been filed under Section 482 of Criminal Procedure Code, to direct the respondent to complete the investigation in Crime No.120 of 2019 on the file of the respondent Police Station and file the charge sheet before the Judicial Magistrate No.3, Puducherry and complete the trial within a reasonable period.

ORDER

This petition is filed to complete the investigation in Crime No.120 of 2019 on the file of the respondent police and file the charge sheet within the reasonable period. This petition is filed on 20.11.2023.

2. The learned Additional Public Prosecutor, (Puducherry) submits that final report in this case was made ready on 31.12.2020, but taken on file by the learned Judicial Magistrate No.III, Puducherry only recently and assigned C.C. No.368 of 2023 and this case is posted on 21.12.2023 for further proceedings.

3. Recording the same, this Original Petition is disposed of. The learned counsel for the petitioner states that the petitioner is a life convict, confined in Puducherry Prison in connection with other case ended in conviction, due to pendency of the present case in Crime No.120 of 2019, now culminated into C.C. No.368 of 2023, his premature release is delayed. Taking note of the above submission, the trial Court is directed to take up the trial and complete it as early as possible.
