The petitioners are A1, A2 and A3 in Crime No.356 of 2023, registered by the respondent police for the offences punishable under Sections 294(b), 323, 324 & 307 of IPC. They had been remanded to judicial custody on 25.10.2023.
2.It is stated that there was a previous dispute between the accused persons and the injured but on 19.10.2023, without any prior provocation, the accused appear to have assaulted the injured person. The injured was in hospital from 19.10.2023 till 25.10.2023. 3.It is stated that a procedure had been initiated to detain the 2nd and 3rd petitioners/A2 and A3 under Tamil Nadu Act 14 of 1982. With respect to the 1st petitioner/A1, it is stated that he had been earlier detained under Tamil Nadu Act 14 of 1982 and had been subsequently released from the said detention but after he came back, he had
committed the present offence. There are also previous cases including under Section 302 IPC against the accused persons. 4.In view of all these facts and the period of hospitalization, which is nearly about six days and the bad antecedents of the petitioners, I am not inclined to grant bail to the petitioners. Accordingly, this Criminal Original Petition stands dismissed.
