This Criminal Original Petition has been filed seeking a direction to the first respondent to transfer the investigation in Crime No.67 of 2025 dated 29.01.2025 registered under Section 194(1) of BNSS, pending on the file of the second respondent to the fourth respondent. 2.
Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Criminal Side) appearing for the respondents.

The contention of the learned counsel appearing for the petitioner is that the petitioner's father was found dead with head injuries under suspicious circumstances. He further submitted that the investigating officer failed to collect the digital evidences, has not conducted the investigation properly and even after the lapse of several months, none of the family members has been enquired. The petitioner has also sent a representation to the first respondent seeking transfer of the investigation and since no action has been taken, the petitioner has filed the present petition.

Learned Government Advocate (Criminal Side), on instructions, submitted that the petitioner's father, aged about 76 years, accidentally fell near the river bed due to its slippery nature, sustained head injures and died. He further submitted that the investigation is already been being conducted in the proper direction.

Be that as it may, considering the fact that the petitioner's father died on 29.01.2025 and there is no further progress in the investigation and the prosecution contends that it is only an accidental death, this Court is of the view that the Deputy Superintendent of Police of the jurisdiction concerned shall conduct further investigation and file the final report as expeditiously as possible.

With the above directions, this Criminal Original Petition stands allowed.
