Heard Ms. N.Gayathri, Learned Counsel for the Petitioner, Mr. V.Ravi, Learned Special Government Pleader appearing for the First Respondent, Mr. A.C.Manibharathi, Learned Counsel for the Second and Third Respondents and Mr. S.Rajendran, Learned Counsel for the Fourth Respondent and perused the materials placed on record, apart from the pleadings of the parties. 2.

The Writ Petition has been filed for directing the Second Respondent to take appropriate action against the Fourth Respondent and to direct him to clean the common passage.

When it is pointed out that the husband of the Petitioner has already filed a suit in O.S. No. 1431 of 2022 the before III Assistant Judge, City Civil Court in respect of the same property against the Fourth Respondent seeking the relief sought in this Writ Petition, Learned Counsel for the Petitioner seeks 3/5

permission of the Court to withdraw the Writ Petition reserving the rights of the Petitioner to raise all her contentions in the said suit filed by her husband and she has also made an endorsement to that effect in the court record. In fine, the Writ Petition is dismissed as withdrawn with the aforesaid clarifications. No costs.
