Respondents PRAYER: The Habeas Corpus Petition is filed under Article 226 of the Constitution of India for the issuance of a Writ of Habeas Corpus, to direct the 1st and 2nd respondents to produce the detenu namely Love Advik Prince, the minor son of the petitioner who is being held in illegal custody by the 3rd and 4th respondents before this Court and hand over to the petitioner.

ORDER

(The order of the Court was made by J.Nisha Banu,J.) This Habeas Corpus Petition has been filed by the father of the detenu seeking for a direction to the 1st and 2nd respondents to produce the detenu namely Love Advik Prince, the minor son of the petitioner who is being held in illegal custody by the 3rd and 4th respondents before this Court and hand over to the petitioner.

2. According to the petitioner, his minor son, Love Advik Prince, aged 3 years, is unlawfully detained by the 3rd and 4th respondents. The 3rd respondent is the wife and the 4th respondent is the mother-in-law of the petitioner. It is stated by the petitioner that his wife has gone to Dubai for employment and his mother-in-law is not allowing him to see his child.

3. Today, the petitioner is present before this Court. The maternal grand-mother/4th respondent along with the child/detenue is present before this Court.

4. The maternal grand-mother/4th respondent would state that her daughter/3rd respondent has gone to Dubai for employment and she will

come to India shortly. She would further state that her daughter had left the child under her care and custody..

5. When the petitioner took the child from his maternal grandmother, the child started crying. The child/detenue is not in illegal custody. The child is happy with the maternal grandmother. Therefore, we are of the opinion that the petitioner has to work out his remedy before the appropriate forum. Accordingly, this Habeas Corpus Petition is closed.
