O R D E R

The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 191(2), 296(b), 115(2), 140(3), and 351(2) of BNS and Section 4 of Tamil Nadu Prohibition of 1/6

Harassment of Women Act, 2002 in Crime No. 107 of 2025, on the file of the respondent Police, seeks anticipatory bail.

The allegation against the petitioners is that on 15.06.2025 at about 7.30 pm, the de-facto complainant viz., Selvapriya, lodged a complaint before the K.V.Kuppam Police Station, stating that when she was at her home, a group of accused persons had assaulted the de-facto complainant and dragged her outside from house and tied with a tree and beaten up her due to previous enmity. When the son of the de-facto complainant intervened to protect her, he was also physically assaulted. Thereafter, the accused persons forcibly took her to Kaliyamman Temple in Kangukuppam, where she was again assaulted with wooden sticks, verbally abused filthy language and threatened with dire consequences. Hence the case.

3. Learned counsel appearing for the petitioners submitted that the petitioners are innocent persons and they have been falsely implicated in this case. He further submits that the entire complaint is a fabricated version of a prior civil dispute. He further submitted that the petitioners are ready to abide by any stringent condition that may be imposed by this Court. Hence, 2/6

he prayed for grant of bail to the petitioner.

The learned Government Advocate (Criminal side) for the respondent police, reiterated the prosecution case and submits that the allegations are serious in nature, involving public humiliation, physical violence and criminal intimidation of a woman and her son. He further submits that A2 was arrested and released on bail. He further submits that the investigation is pending against the petitioners. Therefore, he strongly opposed for grant of anticipatory bail to the petitioners.

Taking into the fact that all the allegations levelled against the petitioners herein, are serious in nature, involving public humiliation, physical violence and criminal intimidation of a woman and her son. Already, Crl.O.P.17933 of 2025, dated 17.07.2025 dismissed against the petitioners herein and now, there is no changes of circumstances in this case and the investigation in this case is yet to be concluded, at this stage, this Court is not inclined to grant anticipatory bail to the petitioners. 3/6
