ORDER

This Writ Petition has been filed seeking a direction to the 1st and 2nd respondents to survey and fix the boundary stones of the petitioner's property for the land in Tiruvallur district, Avadi taluk, Kovilpathagai village in survey No.13 Part , Plot no.164 in Ganapathy Nagar measuring to a total extent of 2400 sq ft based on the petitioner's application for the same vide Challan No.2024/0178/01/000120 dated 26.09.2024.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The petitioner owns a property in Tiruvallur district, Avadi taluk, Kovilpathagai village in survey No.13 Part , Plot no.164 in Ganapathy Nagar measuring to a total extent of 2400 sq ft. In order to survey the said land, the petitioner submitted an application before the respondents. So far the respondents did not take any steps to survey and demarcate the land belongs to the petitioner. Hence, this writ petition.

4. In view of the above, the first respondent is directed to survey the petitioner's aforesaid land based on the title deed produced by the petitioner, after issuance of notice to the adjacent land owners and counter parties, if any, and to serve the survey report to the petitioner

within a period of six weeks from the date of receipt of copy of this order. It is made clear that, if the surveyor concerned is obstructed by third parties while surveying the subject land, the said surveyor can approach the jurisdictional police seeking police aid and on such request, the jurisdictional police shall provide adequate police protection to the surveyor.

5. With the above direction, this writ petition is disposed of. There shall be no order as to costs.
