The petitioner seeks anticipatory bail in Crime No.703 of 2023 registered by the respondent police for the offences punishable under Sections 7 & 20(ii) of COTPA Act r/w Section 279 & 328 of IPC.

2. It is stated that the petitioner was in a vehicle in which there were 420 kgs of banned tobacco products. The petitioner had run away. Investigation can never commence, since the respondent will have to determine from where the banned tobacco was procured and where it was transferred and who are the retailers.

3. In view of all these facts, I am not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed.
