Prayer : Petition filed under Article 226 of the Constitution of India seeking a writ of Mandamus directing the respondents 1 to 10 to take immediate and appropriate action against the 11th respondent for illegal extraction and commercial sale of alluvial lake soil from Government Lake in Survey No.49, Gulur Village, Thiruttani Taluk, Thiruvallur District and direct the 7th Respondent to cancel any permission or license granted to the 11th respondent for excavation of lake soil from the said Government Lake with imposing a penalty/fine on the 11th respondent for environmental degradation, misuse of Government resources, and block market sales. ORDER
(Order of the Court was made by the Hon'ble Chief Justice) This public interest litigation is filed seeking Mandamus directing official respondents to take action against eleventh respondent on the allegation that he has indulged in illegal and excess excavation of 421 cubic meters of silt from Gulur Mavoor
Tank, Tiruttani Taluk, Tiruvallur District.
2. The status report, which has been filed by first respondent, clearly shows that allegations made by petitioner have been proved to be correct, as, Surveyor report shows that private respondent is, in fact, involved in illegal excavation of 421 cubic meters. The affidavit states that now appropriate proceedings would be initiated for taking action against private respondent.
3. We direct sixth respondent to draw expeditious proceedings and pass orders within a period of two months after giving an opportunity of hearing to eleventh respondent within a period of two months. Petition is disposed. There shall be no order as to costs.
