In a suit for recovery of a sum of Rs.3,98,00,000/-, the intending plaintiff seeks leave to sue.
2. Learned counsel for the applicant submits that the cause of action arose within the jurisdiction of this Court when the fourth and fifth defendants borrowed a sum of Rs.5 crore from the applicant. He further submits that a meeting was held in Chennai on 23.09.2019 with regard to the said loan and an undertaking letter was also executed by the first and third defendant in Chennai in relation to the loan. Since the schedule A property is situated outside the jurisdiction of this Court and defendants 4 to 6 reside outside the jurisdiction, leave has been prayed for.
3. Upon examining the draft plaint and on considering the submissions, it is evident that at least part of the cause of action arose within the jurisdiction of this Court. Therefore, A.No.907 of 2023 is allowed by granting leave to the applicant to sue respondents 4 to 6 before this Court and to sue in respect of properties situated outside the jurisdiction of this Court.
