This civil miscellaneous petition has been filed by the petitioners seeking to condone the delay of 97 days in filing the above appeal.

Mr.Govind Chandrasekhar, learned counsel, who takes notice for first respondent, submitted that he has no objection in condoning the delay.

Mr.Raj Sharath P., learned counsel representing Mr.V.Balamurugan, learned counsel on record for the second respondent, submitted that the claim against second respondent is given up. He has also made an endorsement in the court bundle to that effect.

Having regard to the reasons stated in the affidavit filed in support of this petition and being satisfied with the same, the delay is condoned and this petition is accordingly ordered.
