Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the second respondent to consider petitioner's representation dated 26.07.2024 and to conduct proper enquiry in regard to the disbursal of Rs.1,00,87,183/- to 5th to 7th respondents towards payment of alleged Fair Compensation for acquiring 1420.85 sq.ft of land situated in Survey No.1/1C, Sholinganallur Village, Chennai Revenue District and to recover the disbursed compensation money.

ORDER

The relief sought for in this writ petition is to direct the second respondent to consider petitioner's representation dated 26.07.2024 and to conduct proper enquiry in regard to the disbursal of Rs.1,00,87,183/- to 5th to 7th respondents towards payment of alleged Fair Compensation for acquiring 1420.85 sq.ft of land situated in Survey No.1/1C, Sholinganallur Village, Chennai Revenue District and to recover the disbursed compensation money.

2. Mr.P.Sathish, learned Additional Government Pleader takes 2/6

notice on behalf of the respondents. By consent of both the parties, this writ petition is taken up for final hearing at the admission stage itself.

The case of the petitioner is that the land comprised in Survey No.1/1B to an extent of 1420.85 sq.ft situated at Sholinganallur Village, Chennai Revenue District was belongs to petitioner's family. The State Highways department decided to acquire land for the purpose of widening the East Coast Road from Thiruvanmiyur to Akkarai. Accordingly, the aforesaid land was acquired. Instead of settling the compensation amount to the petitioner's family, the State Highways Department, after suppressing such material evidence, illegally disbursed a sum of Rs.1,00,87,183/- to the respondents 5 to 7. In this regard, the petitioner has sent a representation dated 26.07.2024 to the second respondent, seeking to conduct enquiry. However, the said representation was not considered, as on date. Hence, the petitioner has come forward with the present writ petition.

4. When the matter was taken up for hearing, learned counsel for 3/6

the petitioner submitted that, it would suffice, if this Court issues direction to the second respondent to consider the petitioner's representation dated 26.07.2024.

5. Learned Additional Government Pleader appearing for the respondents 1 to 4 submitted that the petitioner's representation dated 26.07.2024 would be considered and appropriate orders passed, within a time frame that may be fixed by this Court.

6. Heard the learned counsel on either side and perused the materials available on record.

Considering the limited relief sought for by the learned counsel for the petitioner, this Court without going into the merits of the case, directs the second respondent to consider the petitioner's representation dated 26.07.2024 and pass appropriate orders on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.

With the aforesaid direction, this writ petition is disposed of. No costs.
