PETITION under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the respondent to provide separate electricity service connection to the petitioner's house at door No.3/5, Indra Gandhi Street, Puthamma Nagar, Tiruporur Taluk, Kancheepuram District in pursuance of his representation dated 24.8.2016 within a time frame as may be fixed by this Court.

ORDER

I have heard Mr.R.Veeramani, learned counsel for the petitioner and Mr.P.Gunaraj, learned Standing Counsel appearing for the respondent.

2. The petitioner seeks a direction to the respondent to provide separate electricity service connection to his house at door No.3/5, Indra Gandhi Street, Puthamma Nagar, Tiruporur Taluk, Kancheepuram District by considering his representation dated 24.8.2016.

3. The petitioner would state that his father owned a house property in S.F.Nos.104 and 105 and that the petitioner along with his father and brother were residing in the property for several decades. He would further state that his father Mr.Kathavarayan was provided with an electricity service

connection bearing No.585-004-306. The petitioner would also state that there was a family arrangement between the petitioner and his brother in the presence of panchayatdhars, that a portion was allotted to the petitioner and that he constructed a house, which has been assigned door No.3/5. According to the petitioner, the property is assessed to property tax by the Local Authority. The petitioner submitted a representation dated 24.8.2016 for grant of separate electricity service connection to his house. Since the said representation has not yet been considered, the petitioner is before this Court by way of this writ petition.

4. The learned counsel for the petitioner has reiterated the above facts and prayed for issuance of appropriate directions so that the petitioner would be able to secure separate electricity service connection.

Mr.P.Gunaraj, learned Standing Counsel appearing for the respondent submits that the petitioner should submit an application form for grant of electricity connection, that it should accompany the title deeds, property tax receipts, etc., and that if the application is submitted in the appropriate form furnishing full details, the same will be considered in accordance with relevant Regulations.

6. As could be seen from the documents in the typed set of papers, the petitioner submitted a representation and he has not given any application form.

7. In the light of the stand taken by the respondent Board, the writ petition is disposed of with a direction to the petitioner to submit an application form as provided by the respondent Board including all the relevant documents and if the same are furnished in full form, the respondent is directed to consider the application and pass appropriate orders on merits and in accordance with law within a period of three weeks from the date, on which, the application is submitted.
