ORDER

This Writ Petition has been filed to direct the first and second respondents to provide adequate police protection and assistance to the Advocate Commissioner and the petitioner to take physical possession of the Secured assets as ordered by the learned Chief Metropolitan Magistrate, Egmore, Chennai by an Order dated 18.03.2024 in Crl.MP.No.43270/2023.

2. The petitioner filed a petition before the learned Chief Judicial Magistrate to take possession of the secured assets obtained under the Mortgage by MODT in favour of the petitioner by appointing an Advocate Commissioner. The learned Chief Judicial Magistrate had appointed an Advocate

Commissioner to take physical possession of the secured assets. The Advocate Commissioner is unable to execute the warrant as adequate police protection has not been provided by the respondents. Hence, the present petition has been filed seeking aforesaid relief.

3. The learned Government Advocate [Criminal Side] on instructions submitted that they would provide necessary protection to the Advocate Commissioner to execute the Order of the Court.

4. In such view of the matter, there shall be a direction to the respondents to provide necessary police protection to the Advocate Commissioner to enforce the Order of the Court.

5. With the above direction, this Writ Petition is disposed of. 18-09-2025
