Prayer:- Writ Petition filed under Article 226 of the Constitution of India, 1950, praying to issue a Writ of Certiorarified Mandamus, to call for the records and quash the order passed by the Second to Fourth Respondents vide PR.No. 95/220 dated 27.07.2020, R.C.No. B1/Appeal No.24/2020 dated 02.11.2020 and Rc.No.813697/AP.IV(1)/2020 dated 19.05.2021 quash the same and direct the Respondents to remove the Black Mark.

Heard Mr. R.Rayeesa Fathima, Learned Counsel for the Petitioner and Mr. B.Vijay, Learned Additional Government Pleader appearing for the Respondents and perused the materials placed on record, apart from the pleadings of the parties.

The Petitioner, who is working as Head Constable in the Police Department of the Government of Tamil Nadu, has challenged the Order in Rc.No.813697/AP.IV(1)/2020 dated 19.05.2021 passed by the Second Respondent inflicting the penalty of 'black mark' in disciplinary proceedings initiated against her.

It has been brought to notice that the Petitioner has filed a Revision Petition against the same impugned order before the First Respondent, which is pending. In view of the same, Learned Counsel for the Petitioner seeks permission of the Court to withdraw the Writ Petition reserving the right of the Petitioner to pursue the said Revision Petition before the First Respondent and depending upon its outcome, to work out her rights in accordance with law, and she has made an endorsement to that effect in the court record. It is expected that the First Respondent, after hearing the Petitioner and concerned parties following the prescribed procedure, would pass reasoned order in the said Revision Petition dealing with each of the contentions raised on merits and in accordance with law, preferably within a period of three months from the date of receipt of copy of this order.
In fine, the Writ Petition is dismissed as withdrawn with the aforesaid observations. Consequently, the connected Miscellaneous Petition is closed. No costs.
