ORDER
Aggrieved by the rejection of his application seeking legal heir certificate by the 3rd respondent, the petitioner has come forward with this writ petition.
2. Since no adverse order has been passed against the 4th respondent, notice to the 4th respondent is dispensed with.
3. Mr.R.Neelakandan, learned Additional Advocate General, assisted by Mrs.S.Anitha, learned Special Government Pleader, accepts notice on behalf of the respondents 1 to 3. With the consent of the learned counsel appearing for the parties, this Writ Petition is taken up for final disposal at the state of admission itself. Page No.2 of 6
4. The petitioner, a Senior Citizen, claims to be the adopted son of the 4th respondent and her husband. According to the petitioner, he was given adoption during the year 1970. His adopted father passed away on 11.04.2008 and thereafter, he made an application dated 30.05.2025 before the 3rd respondent seeking legal heirship certificate. Subsequently, the 3rd respondent has rejected the request of the petitioner, against which, the present writ petition has been filed.
5. Heard both sides and perused the materials available on record.
6. A perusal of the entire records would reveal that the deceased died in the year 2008, however the petitioner made an application only on 30.05.2025 for issuance of legal heir certificate. The petitioner did not possess any valid adoption deed in his hand and there is no Court order available with the petitioner. However, the documents which are said to have been available with the petitioner are self-generated documents, which will not give any right to the petitioner to claim legal heir certificate. Further, the deceased died in the year 2008 and there is no proper explanation for not making an application for issuance of legal Page No.3 of 6
heir certificate immediately after the death of the deceased. The petitioner has also not approached the Court for issuance of legal heir certificate. In the affidavit, the petitioner has also admitted that the 4th respondent, his adopted mother, is not staying with him and they are not seeing eye-to-eye. Hence, the rejection order passed by the 3rd respondent is perfectly in order, which does not warrant any interference.
7. Accordingly, the Writ Petition is dismissed. However, liberty is granted to the petitioner to approach the competent Civil Court for issuance of legal heir certificate by impleading the legal heirs of the deceased. No costs. Consequently, the connected miscellaneous petition is closed.
