The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 379 of IPC, 21(1), 4(1), 4(1A) of Mines and Mineral Act in Crime No. 147 of 2023, seek anticipatory bail.

2. It is the case of the prosecution that the petitioners herein had engaged four separate lorries bearing Registration Nos. KL 64 L 8566 TATA PRIMA X, KL 41 P 0039 BHARAT BENZ, KL 70 A 9412 BHARAT BENZ and KL 64 L 9921 had taken away rock stone without permit.

3. An objection has been raised by the respondent and a counter has also been filed stating that substantial quantity of rock stones were tried to be transported in those vehicles. It is stated that the lorries had Kerala Registration numbers. The petitioners are also residents at Kerala.

4. Taking all the factors into consideration and the seriousness of the offences involved, I am not inclined to grant anticipatory bail to the petitioners. Accordingly, this Criminal Original Petition stands dismissed.
