2024-12-05Honourable Mr Justice P.B. Balaji1 pages

A.No.5951 of 2024 P.B.BALAJI, J.

This application has been filed seeking extension of the mandate of the arbitral Tribunal for one year from 16.11.2024.

2.I have heard Mr.D.Balaraman, learned counsel for the applicant.

3.I have gone through the affidavit and it is seen that in an earlier occasion also the mandate of the arbitrator was extended up to 16.11.2023 by order dated 09.11.2023. The delay is only because of the pendency of the Civil Appeal in C.A.Nos.5518 & 5519 of 2023 before the Hon'ble Supreme Court.

4.The learned counsel for the respondent fairly submits that the mandate of the arbitrator may be extended since the averments set out in the affidavit are factually correct.

5.Considering the same, the application is allowed and the mandate of the arbitrator is extended by 12 months from 16.11.2024.
