Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records of impugned order in file No.CB 1075731166723 dated 30.08.2023 on the file of 1st respondent and quash the same and direct the 1st respondent to

reissue the passport to the petitioner by considering his application dated 30.08.2023 and grant such other order may deem fit and proper under the circumstances of the case.

O R D E R

The order impugned dated 30.08.2023 would reveal that the petitioner has to submit the final orders passed in the criminal case registered against him or approach the competent Criminal Court for securing an order seeking permission to re-issue the passport. Admittedly, the criminal case is pending against the petitioner. If at all the petitioner has to secure the passport, he has to approach the competent Criminal Court where the criminal case is pending or wait till such, the case is disposed of for reissuance of the passport. This Court do not find any infirmity in respect of the reasons stated in the order impugned that the criminal case is pending against the petitioner.

2. Accordingly, the Writ Petition stands dismissed. No costs. Consequently, the connected Miscellaneous Petition is closed. 10.04.2024 skr Index : Yes Speaking order To
