ORDER

This Civil Miscellaneous Petition has been filed to condone the delay of 42 days in filing this petition to restore the CRP.No.739 of 2025 which was dismissed for default on 23.06.2025.

2. Heard the learned counsel for the petitioner.

3. I have gone through the affidavit filed in support of this petition, and I am satisfied that the petitioner has made out sufficient cause for non appearance on 23.06.2025, due to which, the revision petition came to be dismissed for default.

4. There is no objection on the side of the respondent to allow this petition and restore the civil revision petition.

5. The delay of 42 days in filing this petition to restore the C.R.P.No.739 of 2025 is condoned and accordingly, the Civil Miscellanous Petition in C.M.P.No.23004 of 2025 is allowed.

6. In view of the allowing of C.M.P.No.23004 of 2025 and as there is no objection on the side of the respondent to restore the C.R.P.No.739 of 2025, I am inclined to allow the restoration petition, which is in SR stage viz. C.M.P.SR.No.143948 of 2025.

7. Registry is directed to number the Civil Miscellaneous Petition in SR stage for record purpose and treated as allowed. 17-12-2025 Jd
