C.M.P.No.23183 of 2022 in C.M.A.SR.No.146310 of 2022 N.MALA,J, This Petition has been filed to condone the delay of 1306 days in filing the above Civil Miscellaneous Appeal.
2. The learned counsel for the second respondent filed counter and opposed the condone the delay petition.
3. I have gone through the affidavit filed in support of the petition and the counter filed by the learned counsel for the second respondent and I am of the view that the delay of 1306 days can be condoned on condition that the appellant forfeits the interest for the delay period of 1306 days. 4.Therefore, the delay of 1306 days is condoned and the petition is accordingly ordered, on condition that the appellant shall forefeit the interest for the delay period of 1306 days.
5.Registry is directed to number the Civil Miscellaneous Appeal, if it is otherwise in order and post the same 'for admission' and print the name of M/s.R.Sreevidhya, the learned counsel for second respondent in the cause list at the time of admission.
6. Accordingly, this CMP is ordered.
