Respondents Writ Petition filed under Article 226 of The Constitution of India praying for the issuance of a Writ of Mandamus, directing the respondents to disperse the relief fund for the total loss and damage to the coconut and mango trees planted in the petitioner's land comprised of patta No.53 admeasuring about Ha 2.09.50 Ares situated in Naluvedhapathi village, Vedharanyam Taluk, Nagapattinam District, caused due to Gaja Cyclone on 16.11.2018.

The petitioner is a farmer, who is aged about 77 years and he is in possession of about 2 hectares of agricultural land. He had grown nearly about 550 coconut plants and he expected returns on the coconut plants but unfortunately they were all damaged due to the Gaja Cyclone, which affected Nagapattinam District. The petitioner's land is in Nagapattinam District. In https://hcservices.ecourts.gov.in/hcservices/

this connection, he had given a representation, which was not considered. He then also issued an Advocate's Notice. Since the Advocate's Notice was issued, the District Collector / first respondent forwarded the same to the Joint Director / third respondent by O.M.No.15081/2018/u.1, dated 31.07.2019. However, the third respondent does not appear to have passed any order on the same.

In the light of the above facts and circumstances, this Court is of the view that the third respondent either by himself or with the assistance of the 4th respondent may pass appropriate orders, on the representation made by the petitioner which has already been forwarded to him and also on the basis of the Advocate's Notice and also issue notice to the petitioner and give him an opportunity to put forth his case and pass necessary orders, at any rate, on or before 10.01.2020.

3. With the above observations, the writ petition stands disposed of. No costs.
