The petitioner seeks bail in Crime No.571 of 2023, registered by the respondent police for the offences punishable under Sections 294(b), 353, 332, 307 & 506(ii) of IPC r/w Section 3(1) of TNPPDL Act. The petitioner had been taken into custody on 12.10.2023. 2.It is the case of the prosecution that a Non-bailable Warrant had been earlier issued against the petitioner herein and the petitioner was secured on execution of the said NBW. Thereafter, the petitioner was taken originally to Padalam Police Station at Chengalpet and from there he was taken to the Chittamur Police Station, which was the jurisdictional Police Station under which earlier offences are taken place and warrant had been issued.
3.It had been stated that on the way to the said jurisdictional Police Station, the petitioner wanted the police jeep to stop to relieve himself. It is stated that at that time, he tried to snatch the pistol from the
Sub-inspector of Police and tried to run away and also threw stones on the police party. However, they had shot him on his left shoulder and on his left leg. He was secured and he is still taking treatment at Stanley Hospital. It is also stated that there are several cases pending against the petitioner including under Section 302 IPC.
4.In view of all these facts, at this stage, I am not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed. The respondent may continue to provide treatment for him in appropriate manner.
