Respondents Prayer: Criminal Original Petition is filed under Section 482 of Criminal Procedure Code, pleased to modify the condition (ii) with respect to deposit a sum of Rs.6,20,000/- imposed in Crl.M.P.No.4060 of 2019 in C.A.No.377/2019 by an order dated 28.11.2019 on the file of the Principal District & Sessions Judge at Coimbatore.

O R D E R

The petition has been filed to modify the condition (ii) with respect to deposit of a sum of Rs.6,20,000/- imposed by an order dated 28.11.2019 in Crl.M.P.No.4060 of 2019 in C.A.No.377/2019 on the file of the Principal District & Sessions Judge at Coimbatore.

2.While suspending the sentence arising out of the offence punishable under Section 138 of the Negotiable Instrument Act in C.C.No.163/2017 by an order dated 28.11.2019, the petitioner was imposed with a condition to deposit a sum of Rs.6,20,000/- before the lower Court.

3.The learned counsel for the petitioner submitted that the petitioner is ready to comply the said condition and seeks extension of time to deposit the said amount. 4.Considering the above facts and circumstances the petitioner shall deposit the same amount of Rs.6,20,000/- on or before 19.03.2020 as imposed by the First Appellate Court in Crl.M.P.No.4060 of 2019 in C.A.No.377 of 2019, failing which, the order of suspension of sentence passed by the Appellate Court shall stand automatically cancelled.
