ORDER
This Writ Petition has been filed to direct the respondents 1 to 3 to provide police protection to the petitioner, his representatives, and to the said
property until the construction work in the property is completed and take necessary action against the respondents 4 to 6 and prevent further Criminal trespassing, verbal abuse, physical assaults and threatening of life and security of the petitioner.
2. According to the petitioner, their company had purchased 47 acres of land in OMR Chennai and when they are undertaking cleaning operations in the property, the respondents 4 to 6, who are habitual offenders, are trying to interfere with their possession. In this regard a suit in O.S.No.49 of 2017 has also been filed and the same has been decreed in favour of one Ganesh, who is the vendor of the petitioner. Despite the same, the respondents 4 to 6, who are having political background, are interfering with the possession of the petitioner. Hence, the present petition has been filed seeking aforesaid relief.
3. Whereas, the learned Additional Public Prosecutor appearing for the respondents 1 to 3 on instructions submitted that they had already registered the First Information Report as against the fourth respondent and 50 others in Crime
No.250 of 2025 for the offences under sections 191 [1], 329 [3]. 115[2]. 308 [2] and 351[2] of BNS. The learned Additional Public Prosecutor further submitted that whenever any necessity arise, they will take action as per law.
4. The petitioner company is the lawful owner of the property. In such view of the matter, whenever, there is a problem created by respondents 4 to 6 or their men and intrude in to the property and whenever police protection is required, the respondents 1 to 3 shall take stringent action against them and provide necessary protection to the property.
