PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Certiorarified Mandamus to call for the records in the salesman selection list notification No.1/2022 dated 30.09.2023 issued by the respondent and quash the same and consequently direct the respondent to appoint the petitioner to the post of salesman in any other T.N.Cooperative Society under the category of physically challenged disabled persn, Vellore District.

ORDER
The petitioner herein had participated in the selection process for the post of salesman pursuant to the notification No.1 of 2022 dated 13.10.2022. When the petitioner's name was not included in the selection list published on 30.09.2023, she has preferred the present writ petition.
2. According to the learned counsel for the petitioner, the petitioner belongs to Backward Community and is also physically challenged. On the basis of this priority, the petitioner claims that she is entitled for selection.

Today, when the matter was called, the learned Special Government Pleader, on instructions, had placed the Position Note before this Court, as per which, 9775 applicants had applied for the post of Salesman, out of which 5084 applicants had attended the interview. The provisional selection list was published on 30.09.2023 and appointment orders were also issued on the same day to the successful candidates. Insofar as the petitioner herein is concerned, she comes under the priority of Differently abled person as per her application. In the vacancy of Salesman, only one differently abled person was available for BC-General category and no General turn available 2/5
in the roster system for this category. Accordingly, the petitioner was fitted in the BC General Differently abled person Category as per the 200 point reservation. While considering the candidature in this manner, she had secured 39.83 marks and was placed in the sixth position among the Backward Community General differently abled person candidates. One K.Naveen Kumar had obtained 62.54 marks and his rank was determined as No.1 and accordingly he was selected and appointment order was also issued for that single post. When the petitioner herein had not qualified in the marks awarded by the respondent Bureau and the person who has secured higher marks was appointed, I do not find any illegality or infirmity in the selection process insofar as it relates to disqualification of the petitioner. Accordingly, the writ petition stands dismissed. No costs. Consequently, the connected miscellaneous petition is closed. 27.11.2023 Index:Yes Internet:Yes gpa 3/5
